Uninsured Drivers Beware: Louisiana’s Stricter “No Pay, No Play” Law
Louisiana has long had a “No Pay, No Play” law that limits what uninsured drivers can recover if they’re injured in an accident, even when the other driver is at fault. Starting August 1, 2025, these restrictions are getting significantly stricter.
What Is “No Pay, No Play”?
Louisiana’s No Pay, No Play law is designed to encourage drivers to maintain auto insurance. Under this law, if you’re driving without the required liability insurance and you’re injured in an accident caused by someone else, your ability to recover certain damages is limited.
The Previous Rule
Under the old law, uninsured drivers couldn’t recover the first $15,000 of bodily injury damages or $25,000 of property damage from an at-fault driver. While this was a significant penalty, many serious injuries easily exceeded these thresholds.
The New $100,000 Threshold
Effective August 1, 2025, the threshold for bodily injury jumps dramatically. If you’re driving without insurance and are injured in an accident you didn’t cause, you cannot recover pain and suffering or other general damages unless your injuries exceed $100,000 in value.
This is a massive increase from the previous $15,000 threshold. It means that even relatively serious injuries may not meet this new bar, leaving uninsured drivers with little to no compensation for their pain and suffering.
What Uninsured Drivers Can Still Recover
Even under the new law, uninsured drivers can still recover actual economic damages like medical bills and lost wages. However, general damages such as pain and suffering, mental anguish, and loss of enjoyment of life are off-limits unless the $100,000 threshold is met.
The Bottom Line: Maintain Your Insurance
This change makes it more important than ever to maintain proper auto insurance coverage. The consequences of driving uninsured in Louisiana are now severe. Even if you’re completely innocent in an accident, being uninsured could cost you tens of thousands of dollars in compensation you would otherwise deserve.
