The New 51% Rule: How Louisiana’s Comparative Fault Changes Affect Your Injury Claim
One of the most significant changes coming to Louisiana personal injury law takes effect on January 1, 2026: the new 51% comparative fault rule. This change could dramatically affect your ability to recover compensation if you’re injured in an accident.
What Is Comparative Fault?
In most accidents, determining who is “at fault” isn’t black and white. Sometimes both parties share some responsibility. Comparative fault is the legal system courts use to assign percentages of blame to everyone involved.
For example, if you’re rear-ended at a red light but your brake lights weren’t working, a jury might find you 20% at fault and the other driver 80% at fault.
The Old Rule: Pure Comparative Fault
Until now, Louisiana followed a “pure comparative fault” system. Under this rule, you could recover damages even if you were mostly at fault. Your recovery would simply be reduced by your percentage of fault.
Using our example: if your damages totaled $100,000 and you were found 20% at fault, you could recover $80,000.
The New Rule: Modified Comparative Fault (51% Bar)
Starting January 1, 2026, Louisiana adopts a “modified comparative fault” system with a 51% bar. Here’s the critical change: if a jury finds you 51% or more at fault for the accident, you recover nothing.
Under the new law, juries must be specifically instructed that finding the plaintiff 51% or more at fault means zero recovery.
What This Means for Your Case
This change makes several things more important than ever. First, evidence preservation becomes critical. Photos, witness statements, and documentation that show the other party’s fault are essential. Second, early legal representation matters. Having an experienced attorney involved from the start helps ensure fault is properly attributed. Third, insurance company tactics may change. Expect insurers to argue more aggressively that you were primarily at fault.
